Acceptance to the Terms of Use
These terms of use are entered into by and between you and NC Institute for Child Development Professionals (“Institute,” “NCICDP,” “we,” “our,” or “us”). The following terms and conditions, (“Terms of Use”), govern your access to and use of https://www.ncicdp.org/, including any content, functionality, and services offered on or through https://ncicdp.my.canva.site/salary-scale-toolkit-homepage (the “Toolkit” or “Toolkit Site”).
Please read the Terms of Use carefully before you start to use the Toolkit Site. By accessing, browsing and/or using the Toolkit Site, you accept and agree to be bound and abide by these Terms of Use. If you do not want to agree to these Terms of Use, you must not access or use the Website.
Changes to the Terms of Use
We may revise and update these Terms of Use from time to time at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Toolkit Site thereafter. Your continued use of the Toolkit Site following the posting of the revised Terms of Use means that you accept and agree to the changes.
Intellectual Property Rights
The Toolkit Site and its content, features, and functionality, including but not limited to text, images, display, video, audio, and the design, selection, and the arrangement thereof (“Materials”), are owned by the NCICDP, its licensors, or other providers of such material, and those rights are protected by United States and international copyright and other intellectual property or proprietary rights laws. The Toolkit Site also adopts the CC BY-NC-ND 4.0 Public License (“Public License”). Subject to the terms and conditions of the Public License, the NCICDP hereby grants you a worldwide, royalty-free, non-sublicensable, non-exclusive, irrevocable license to reproduce, reprint and share the Toolkit Site and Materials, in whole or in part, for non-commercial purposes only. You may not modify, transmit, participate in the sale or transfer of, or create derivative works based on the Toolkit Site and Materials, in whole or in part. Reprint and redistribution are only permitted if copies contain an attribution statement giving appropriate credit to the NCICDP as the creator of the Toolkit. You may give credit by providing the name of the creator, a copyright notice, a license notice, a disclaimer notice, and/or a link to the Toolkit Site, or in any other reasonable manner without suggesting that the NCICDP endorses you or your use.
The Toolkit Site and Materials may contain copyrighted content not owned by the NCICDP. The materials, resources and information in the Toolkit is provided for educational and informational purposes and thus is believed to fall under the “Fair Use” guidelines of section 107 of the US Copyright Act of 1976. All rights and credit go directly to the rightful owners. No copyright infringement intended.
You are required to follow such terms and conditions unless you use only elements of the Toolkit Site that are in the public domain, or your use is permitted by an applicable exception or limitation to copyright such as fair use or fair dealing.
If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the Toolkit Site in breach of the Terms of Use, your right to use the Toolkit Site will stop immediately and you must, at our option, destroy any copies of the materials you have made. No right, title, or interest in or to the Toolkit Site or Materials is transferred to you, and all rights not expressly granted are reserved by the NCICDP.
Restrictions on Use of Materials for Educational Purposes
You may use the Toolkit only for lawful purposes and in accordance with these Terms of Use. You may not use the Toolkit in any manner that could damage, disable, overburden, or impair the interest of the NCICDP. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Toolkit Site and other NCICDP websites.
The NCICDP authorizes you to view, access and use the Toolkit Site and Materials solely for noncommercial uses, including for training and educational programs without any fees or profits associated. For instance, you may:

NCICDP provides a multi-level online training program to ensure that participants can utilize the Toolkit resources to the fullest (please for more information). If you are interested in a training program designed to introduce child care center staff, family child care providers, technical assistance specialists, professional development specialists working with early childhood education programs (both center-based and home-based), and early childhood higher education faculty to the Toolkit, fair compensation salary scale, and its effective implementation, please send your request to instituteinfo@ncicdp.org for partnership.

The Materials we have included in the Toolkit are provided for information purposes only. While we strive to always provide accurate, current and helpful resources and information in the Toolkit, no information on the Toolkit Site constitutes tax or legal advice, nor does it create an attorney-client relationship between the NCICDP and any other party. You should always consult a professional with experience and knowledge of childcare businesses to assist you with specific questions or needs.
YOUR USE OF THE TOOLKIT SITE, ITS MATERIALS, AND ANY SERVICES OBTAINED THROUGH THE TOOLKIT SITE IS AT YOUR OWN RISK. The NCICDP reserves the right, in its sole discretion, to restrict, suspend, or terminate this Terms of Use and your access to all or any part of the Toolkit Site or Materials, at any time and for any reason without prior notice or liability. The NCICDP reserves the right to change, suspend, or discontinue all or any part of the Toolkit Site or Materials at any time without prior notice or liability.
Miscellaneous
The Terms of Use are governed by and construed by the laws of the State of North Carolina in the United States, not including its choice of law rules. The NCICDP’s failure to enforce your strict performance of any provision of this Terms of Use will not constitute a waiver of its right to subsequently enforce such provision or any other provision. If any part of the Terms of Use is held to be invalid or unenforceable by any law or regulation or final determination of a competent court or tribunal, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions. The parties agree that no joint venture, partnership, employment, or agency relationship exists between you and the NCICDP as a result of the Terms of Use or from your use of the Toolkit and Materials.
